PREAMBLE

In connection with “La Quadra +40 – Geneva Halloween”, an event organised in Geneva by SW Agency Sàrl, a promotional prize draw is offered in partnership with hype SWISS Sàrl.

The purpose of this promotion is to promote the event, highlight the commercial partnership between the two companies and enable eligible participants to discover the telecommunications services offered by hype SWISS.

Three Melon-Hype mobile subscriptions, provided free of charge for 12, 24 and 36 months respectively, will be awarded by random draw.

This document sets out the General Terms and Conditions of Sale governing ticketing, the specific rules of the prize draw and the respective responsibilities of the parties.

The two companies act in separate capacities and remain legally, financially, contractually and operationally independent.

These rules incorporate and adapt the principles of transparency, single participation, verification, drawing procedures, prize delivery and participant protection established in the official rules of the hype SWISS Grand Prize Draw 2026.

Unlike that earlier competition, which was free to enter and did not require a purchase, this promotional operation is linked to purchasing an event ticket at its usual price.

Its responsibilities include:

1.3. Independence of the Companies

SW Agency Sàrl and hype SWISS Sàrl are separate legal entities and remain legally, financially, contractually and operationally independent.

Their partnership does not constitute a simple partnership, joint venture, general agency arrangement or relationship of mutual representation.

Neither party may legally or financially bind the other without express written authorisation.

1.4. No Ticketing Liability for hype SWISS

hype SWISS is neither an organiser nor a co-organiser of SW Agency events, nor a ticket seller, ticketing intermediary or guarantor of their performance.

1.5. Responsibility for Prizes

hype SWISS is responsible for supplying, awarding and effectively delivering the prizes and performing the services they comprise.

Winners are entitled to enforce against hype SWISS the rights arising under these rules in respect of services provided by hype SWISS.

SW Agency has no obligation to provide, activate or finance the awarded subscriptions unless it has expressly undertaken to do so separately.

1.6. No General Joint and Several Contractual Liability

Each company is responsible for its own commitments, actions and breaches.

The partnership creates no general joint and several contractual liability between them.

Mandatory statutory liabilities remain unaffected.

1.7. Applicable General Terms and Conditions

SW Agency's General Terms and Conditions govern the event and its ticketing arrangements.

hype SWISS's General Terms and Conditions, particularly its Mobile & Data Terms and Conditions, take precedence in relation to the telecommunications products, subscriptions and services supplied by hype SWISS.

The specific benefits expressly guaranteed by these rules, including the nature, duration and free-of-charge status of the prizes and the absence of automatic conversion into a paid subscription, prevail over any conflicting general provision.

ARTICLE 2 — EVENT DESCRIPTION AND ADMISSION

“La Quadra +40 – Geneva Halloween” takes place at:

Venue: Halles de l’Île, Geneva
Start: Friday, 30 October 2026, at 7:00 p.m.

Admission is subject to presentation of a valid ticket, published admission conditions, any applicable identity checks and venue safety regulations.

SW Agency bears sole contractual responsibility for these services.

ARTICLE 3 — PRICES, ORDERS AND PAYMENT

Ticket prices are stated in Swiss francs (CHF).

Tickets are sold at the prices customarily charged by SW Agency Sàrl for comparable events.

Prices are neither increased nor altered because of the hype SWISS promotional prize draw.

No surcharge is charged for a chance to win.

Before placing an order, the purchaser receives information concerning:

An order is confirmed once payment has been successfully validated and confirmation issued.

A payment merely initiated, including through TWINT, is not final confirmation.

SW Agency remains responsible for ticket transactions, payment collection and any refunds.

hype SWISS does not receive ticket payments and has no involvement in ticket invoicing.

ARTICLE 4 — TICKET VALIDITY AND USE

Each ticket entitles its holder to the services and number of admissions indicated in the confirmation.

The purchaser is responsible for safeguarding the ticket and its identification code.

Codes must not be made public, and tickets should be passed only to the intended guests.

A single ticket does not permit simultaneous admission of multiple people.

Ticket transfer, name-change rules and any restrictions are those communicated by SW Agency before purchase.

Transferring a ticket does not automatically transfer a prize draw entry, which remains linked to the original identified and registered purchaser.

Admission checks are the sole responsibility of SW Agency.

ARTICLE 5 — CANCELLATION, POSTPONEMENT AND REFUNDS

Subject to mandatory legal provisions, Swiss law does not provide a general right of withdrawal for purchasing a ticket for an event scheduled on a particular date.

Refund requests arising from a change of mind or the purchaser's failure to attend are governed by the conditions announced before sale.

If the event is definitively cancelled without the agreed service being provided, reimbursement of the ticket price and mandatory fees collected is provided for, subject to applicable law.

If the event is postponed, the purchaser may retain the ticket for the new date or request a refund under the published sales conditions.

Force majeure situations are assessed under applicable law.

SW Agency alone is responsible for contractual obligations concerning ticket refunds.

hype SWISS is not required to reimburse sums collected by SW Agency merely because of the partnership, except where required by law or by its own undertaking.

SW Agency shall communicate the definitive refund deadlines and practical procedures.

ARTICLE 6 — VOLUNTARY PARTICIPATION IN THE PRIZE DRAW

Purchasing a ticket does not make participation in the prize draw compulsory.

The purchaser may freely accept or decline participation.

Refusal does not result in:

Participation requires specific, voluntary acceptance of these rules.

The acceptance checkbox is separate from acceptance of the ticketing Terms and Conditions.

Entering the prize draw does not automatically create a paid subscription.

PART II — OFFICIAL PROMOTIONAL PRIZE DRAW RULES

ARTICLE 7 — PURPOSE, PROMOTIONAL NATURE AND LEGAL FRAMEWORK

7.1. Purpose

hype SWISS offers three prizes consisting of Melon-Hype mobile subscriptions provided free of charge for 12, 24 and 36 months respectively.

The prize draw aims to promote the event, support the partnership between SW Agency and hype SWISS and introduce participants to hype SWISS services.

7.2. Promotional Nature

The draw is a temporary promotional operation associated with the ordinary sale of tickets to an actual event.

It has been designed on the basis of Article 1 paragraph 2 letter d of the Swiss Federal Gambling Act (LJAr; SR 935.51).

The applicability of this exclusion remains conditional upon satisfying all statutory requirements.

7.3. Usual Prices and No Surcharge

Tickets are sold at the prices customarily charged by SW Agency Sàrl for comparable events.

These prices remain unchanged because of the prize draw.

No increase, promotional charge, contribution or surcharge is imposed to finance the draw or its prizes.

The ticket grants admission to a genuine event service regardless of whether the purchaser enters the draw.

No paid telecommunications subscription, additional purchase or supplementary payment is required to enter.

7.4. Single Entry and Prevention of Excessive Gambling

Only one entry per person is permitted.

Purchasing additional tickets provides no additional chances of winning.

No paid mechanism enabling repeated entries is offered.

The promotion is time-limited and does not include mechanisms designed to encourage excessive gambling.

7.5. Legal Classification

The operation is designed to fall within the exclusion under Article 1 paragraph 2 letter d LJAr for certain sales promotion games.

Whether that exclusion actually applies depends on satisfaction of all statutory conditions and any assessment by the competent authorities.

The prize draw must not be advertised as “no purchase necessary”, because entry is restricted to eligible purchasers.

ARTICLE 8 — ELIGIBILITY AND SINGLE ENTRY

8.1. Eligibility Requirements

Entry is open to natural persons who:

8.2. Single Entry

One participant = one entry = a maximum of one prize.

A person cannot increase their chances by purchasing additional tickets, creating multiple accounts or using several email addresses.

The entry belongs to the purchaser identified in the order, not automatically to their guests.

8.3. Exclusions

Persons directly involved in configuring, technically organising or supervising the draw, and persons with privileged access that could compromise its impartiality, are excluded.

Exclusions apply on objective grounds.

8.4. Identity Verification

hype SWISS may request documents necessary to verify identity, age and domicile and to comply with the regulatory requirements for activating the subscription.

8.5. Fraud

Fictitious entries, manipulation, identity theft or fraudulent multiple entries may lead to exclusion following documented verification.

Good-faith clerical errors may be corrected where fairness is not compromised.

ARTICLE 9 — REGISTRATION AND hype SWISS ACCOUNT

9.1. Registration at Purchase

The purchaser may enter the draw by voluntarily checking the designated box on the Quadra ticketing platform.

The box is not preselected.

The rules and data processing information must be accessible before acceptance.

9.2. Technical Transmission

Once payment is confirmed, the necessary information is transmitted to hype SWISS through the technical integration connecting the platforms.

9.3. Account Creation or Identification

Where a hype SWISS account already exists, the entry is linked to that account.

Otherwise, an account is created according to the information provided to the purchaser.

Account creation does not automatically result in a paid subscription.

9.4. Technical Exclusions

Complimentary invitations, test orders and door sales do not participate through this mechanism unless otherwise announced before the draw opens.

No retroactive entry is created without valid prior acceptance.

9.5. Platform Responsibilities

SW Agency remains responsible for its ticketing platform and technical operations attributable to it.

hype SWISS remains responsible for entries and operations managed on its own platform.

ARTICLE 10 — ENTRY PERIOD AND CLOSING

10.1. Opening

Entries open when the prize draw participation option is officially activated on the Quadra platform.

The actual opening date and time are displayed when the draw is launched and recorded in the published version of the rules.

10.2. Closing

Entries close no later than Saturday, 31 October 2026, at 2:00 a.m., subject to earlier closing where necessary if the draw takes place during the event.

In all cases, entries close before the draw begins.

The precise closing date and time are communicated to participants before they complete registration.

10.3. Payment Validity

Payment must be confirmed before the effective closing time.

An unpaid reservation or unconfirmed payment does not qualify.

10.4. Technical Delays

A purely technical transmission delay between Quadra and hype SWISS does not extend the entry period.

Orders properly confirmed during the eligible period are reconciled and verified before the draw.

10.5. Final Closing

No new order becoming eligible after closing may be admitted.

Holding the draw after the event does not extend the entry period.

ARTICLE 11 — REFUNDS, CANCELLATIONS AND CORRECTIONS

11.1. Full Refund

A full refund before the draw of the only eligible order results in removal of the corresponding entry.

11.2. Other Eligible Orders

Where another order remains valid, paid and accompanied by acceptance of the draw, the participant's single entry may be maintained.

11.3. Partial Refunds

Partial refunds are assessed individually and cannot generate additional entries.

11.4. Identity Corrections

Clerical errors may be corrected where their origin can be verified.

A justified correction does not automatically constitute fraud.

11.5. Refunds After the Draw

Any refund request after the draw that may affect a prize is subject to documented review.

It does not automatically cancel the prize or trigger a new award.

11.6. Respective Responsibilities

SW Agency decides and executes ticket refunds in accordance with its obligations.

hype SWISS assesses only their possible consequences for entry and prize validity.

ARTICLE 12 — DRAW DATE, VENUE, PROCEDURE AND LIVE BROADCAST

Participants are not required to attend or connect to the broadcast.

If a technical incident affects only the livestream, the draw may proceed provided it remains verifiable and documented. Participants will be informed appropriately.

12.4. Announcement of the Time

hype SWISS will announce the exact date and time once determined, wherever possible before entries close.

The draw may not take place after Wednesday, 4 November 2026, except in duly justified exceptional circumstances, following notification to participants and any adjustment required by applicable law.

12.5. Entry List

Following closing, eligible entries are verified, duplicates removed, and the final list recorded and timestamped.

Any corrections are documented.

12.6. Selection Method

Three distinct winners are selected without replacement.

The prizes are drawn in this order:

No advantage is granted for:

12.8. No Attendance Requirement

Participants need not attend in person, whether the draw is held during the event or at the hype SWISS Center.

A winner's absence does not invalidate their entitlement.

12.9. Animation and Results

Any visual animation, including a spinning wheel, merely displays a result already recorded.

It does not determine the winner.

12.10. Verification and Traceability

The draw is supervised by at least two persons, one of whom must not have configured the selection system alone.

Parameters, results and any corrections are recorded in minutes or a technical log.

Announcements remain subject to eligibility verification.

hype SWISS assigns the winner a new Swiss mobile telephone number, provided on a new physical SIM card or eSIM, depending on technical availability and the beneficiary's preference.

b) Retaining the Current Number — Number Portability

The winner may retain their existing Swiss mobile number with another operator, provided they are its lawful subscriber.

The number is transferred to hype SWISS through the applicable number portability procedure.

hype SWISS submits the portability request on the winner's behalf, based on a duly signed authorisation.

The winner must not personally cancel their existing contract with their current operator before the number has been transferred.

Termination of the corresponding mobile service with the previous operator takes place as part of the portability procedure, in accordance with the applicable conditions.

Any early termination fees, contractual commitments, minimum contract periods, remaining monthly charges or other amounts owed to the previous operator remain entirely the winner's responsibility, in accordance with Article 15 of these rules.

Services, options or communications not included in the subscription remain chargeable under the applicable Terms and Conditions and tariffs, following appropriate prior disclosure.

17.8. End of the Free Service Period

Upon expiry of the awarded period, the subscription will not automatically renew or convert into a paid subscription.

Any paid continuation requires the beneficiary's express consent and the conclusion of a contract specifying the applicable pricing conditions.

17.9. Applicable General Terms and Conditions

hype SWISS's Mobile & Data Terms and Conditions govern the activation, number portability, use and provision of telecommunications services.
